▍ Jiaquan Express - Typical IP Case Award in 2021

Represented by Jiaquan IP Law, an administrative litigation dispute case on invalidation of patents in the field of biomedicine was selected as a typical case of intellectual property rights in 2021 by Guangdong IP Protection Association.

On April 26, 2022, the 22nd World Intellectual Property Day, the Guangdong IP Protection Association's 2021 Annual Report Meeting on Typical Intellectual Property Cases was successfully held. Mr. Tan Yingqiang, the Deputy General Manager of Jiaquan IP Law, was invited to attend, accepted the 2021 Typical IP Case Award, and shared the case of invalidation of patents in the field of biomedicine represented by Jiaquan at the meeting.

According to Mr. Tan, this case was teamwork of Jiaquan’s attorneys with nearly six years of continuous efforts. The case has gone through the invalidation procedures, the first instance of invalidation administrative litigation, the second instance of invalidation administrative litigation, the retrial procedures, and finally achieved the ultimate victory by declaring all the invention patents involved in the case invalid.

In this case, a combination strategy with seven invalidation reasons was adopted, especially the excellent use of the invalidation reason of "the claims are not supported by the specification", which provided guidance for drafting patent applications in the field of biomedicine and offered a typical reference for developing invalidation strategy for biomedical inventions.

Mr. Haihua Tan, the Presiding Judge, spoke highly of this case. His comments include: these patents involved complicated and advanced technologies in the field of biomedicine, and thus were difficult to be invalidated. This case fully reflected the professional knowledge and ability of the attorney.
