Trademark practice – never submit a political landmark of a country as a trademark application in China

When people talk about different countries, the building or facility that represented the country is always one of the topics. And many of these have their special meanings in the political aspect, like the White House in the US, Buckingham Palace in the UK, Versailles in France, and the Kremlin in Russia. Citizens in these countries must be proud of their landmarks. But are these available for trademark applications in China? Similar questions are frequently received.

Kindly note, under the Chinese trademark practices, realistic photos or detailed pictures of these landmarks will lead to refusals easily, because of the political sensitivity factors. This is the absolute ground with high risks. No recommendation about this method from our side.

However, a business plan is rather complicated. And as one of the important parts of it, giving up on a trademark layout will have sequent impacts. Is there an alternative option? In fact, there is one, if the client insists - simple brief strokes or sketchings with simple lines of the landmark should be a better shot, although no absolute guarantee. In this case, the image doesn't give a direct reflection of the landmark after the designer's modifications. But still, it might not go in the exact same way the applicant once wanted. To be or not to be, that's the client's decision.
